Contact us today for a free consultation with a Florida attorney you can trust.
My name is Mike Ziegler. I am the managing attorney for Ziegler Diamond Law. We’re committed to helping people get control of serious debt. When you work with us, it’s no longer just your debt problem, it’s ours as well. We’re here to help you get back on track as soon as possible.
Before you borrow money from family members, take out a second mortgage, contract with debt settlement companies, or leverage other assets, we’d recommend you seek legal advice from a proven debt settlement attorney.
What does it mean to get your life back from overwhelming debt?
Is it being able to support your family? Reducing credit card debts? Or answering the phone again without fear of a debt collector? What about saving enough to buy a home without worrying that your money will be taken from your bank account by debt collectors?
If you’re tired of the never-ending phone calls, outrageous interest rates, text messages, emails, and stress from aggressive creditors, then it’s time to seek experienced and trusted legal representation debt settlement lawyers you can trust.
First, our debt relief lawyers develop your personal Debt Freedom Strategic Plan.
Are you judgment proof? Did your creditors file their case with the wrong court? We look at all of your options for debt relief – such as Chapter 7 bankruptcy, Chapter 13 bankruptcy, debt litigation defense, foreclosure defense and modifications, credit error claims, and credit harassment claims – and offer the recommendation that is most advantageous to you based on our experience.
Second, we monitor your rights to protect you from Debt Collector & Creditor Harassment.
State and Federal laws say you are entitled to protection from aggressive debt collection, even if you are behind. A creditor can’t call you constantly, or at odd hours, they generally can’t call third parties about your debt, and they can’t call your employer about your debt unless permitted by a judgment. And when you have retained an attorney to deal with your Debts and negotiate debt settlements, they can’t call you at all!
Third, we execute your Debt Freedom Strategic Plan.
Our goal is to get rid of your debt, either by seeking a discharge in Chapter 7 bankruptcy or setting up a payment plan with your creditor (i.e., debt settlement plan) that fits your budget in Chapter 13 bankruptcy or debt consolidation.
Finally, we help get your credit back on track.
We review your credit report after the bankruptcy or debt settlement payment plan is complete, to make sure you get the credit reporting benefits you are entitled to, and we give you the tools and information to help your credit score rehabilitate as fast as possible.
Chapter 7 bankruptcy attorneys – Chapter 7 is considered the “liquidation” form of bankruptcy. In Chapter 7, the filer is not required to commit to a payment plan with debt collectors to eliminate their debt. However, in some instances, if the filer owns belongings beyond certain allowances (called “exemptions”), they may have to give up the “extra” belongings or pay extra into the bankruptcy to get the bankruptcy order wiping out the debt (called the “discharge order”). There is an income qualification for chapter 7 called the means test.
Chapter 13 and Chapter 11 bankruptcy attorney – Chapter 13 and Chapter 11 are known as the “reorganization” chapters of bankruptcy. Chapter 13 is a payment plan form of bankruptcy with payments that last from 3-5 years. While there are several factors that go into calculating the payments, in general, the payments are based on what the filer can afford to pay; which is set out in the “disposable income test” under the bankruptcy code.
Defending and Negotiating Debt Collection Lawsuits – Suppose you owe a creditor money and they are filing a lawsuit against you. In that case, a lawyer at our firm can help defend you against lawsuits for credit card debt, vehicle deficiencies, medical debts, business loans, foreclosure deficiency, and union mortgage claims.
Creditor Harassment Claims – Just because it’s been difficult to pay a creditor, it doesn’t give them the right to harass or threaten you to settle the debt. If they do, you may be entitled to compensation. Most debt settlement companies can’t offer this service because they are not run by a licensed debt settlement lawyer.
Credit Error Claims – Suppose your creditors haven’t updated your credit report or have reported false information. If their errors are negatively affecting your credit history our attorneys can potentially help hold them accountable.
Foreclosure Defense Attorneys – In many instances, we’re able to avoid bankruptcy altogether. Particularly where someone has been sued by a mortgage company, the same court rules apply as in any other legal proceeding. We may be able to challenge the creditors in court and communicate with them to reach a beneficial conclusion, such as a loan modification, a deed-in-lieu, a judgment with agreed-upon terms, or other options to settle your debt.
Debt settlement, debt consolidation, credit error claims, creditor harassmment, and foreclosure are not things debt settlement companies are the best at dealing with. When a creditor sues or considers legal action, a debt relief or debt settlement lawyer is uniquely qualified to help. We’re here to help consumers who need a debt lifeline. Contact us today to speak with an experienced Florida debt settlement lawyer.
Suppose you’re trying to save money, get rid of unsecured debt, or undergo debt consolidation. In that case, personal injuries caused by car accidents can put a wrench in all of those plans. That’s especially true if fault is unclear or the insurance company makes a lowball settlement offer.
If too many creditors are already calling you, can you imagine how much worse it could get if you don’t have enough money to pay debts because of car accident injuries?
At Ziegler Diamond Law, our experienced attorneys are dedicated to helping you and your family reach your current and future financial goals. That includes aggressively pursuing maximum compensation (via negotiation or legal action) for car accident injuries caused by recklessness or negligence.
In addition to debt settlement for consumers, we help Florida personal injury victims to seek and recover the compensation they’re owed for medical debts, lost income, pain, suffering, and more. Learn more about our personal injury services below.
If you or a loved one has suffered catastrophic injuries (up to wrongful death) due to the negligence or recklessness of another driver, our personal injury attorneys are here to help you recover maximum compensation. We represent our clients in the following types of personal injury cases:
Wrongful Death Lawsuit – If you’re loved one lost their life due to the actions of another person, a lawyer can help hold responsible parties accountable.
Car Accident Lawsuit – Determining fault in a Florida car accident case typically requires the skill, experience, and legal knowledge of a proven attorney.
Rideshare Accident – Injuries sustained in rideshare accidents are expensive. Don’t deal with a rideshare insurer or lawyer on your own, we’re here to help you recover maximum compensation.
Truck Accident – Truck accidents are among the most dangerous, devastating, and expensive types of accidents. Call us to speak with an attorney about your personal injury case.
Workers Compensation Claims for work-related accidents – If you were injured in an accident at work, you may be eligible to pursue a worker’s compensation claim and personal injury claim. Contact us to discuss your case with a proven personal injury lawyer.
You don’t have to accept a lowball settlement offer or a denied claim. Let our Florida personal injury lawyers deal with the insurance company while you focus on getting better. Contact us today for a free consultation.
Every personal injury case is different. Some cases require aggressive negotiations until the insurer agrees to a fair settlement offer. More complicated cases (i.e., multi-vehicle crashes, commercial truck accidents, etc.) can lead to weeks, months, or years in court before a ruling or both sides mutually agree to settle. Regardless of your circumstances, our personal injury process generally includes:
Initial Consultation With a Personal Injury Attorney – We want to learn everything about your car accident and resulting injuries. The more information and evidence we can obtain, the less likely we are to settle for anything less than maximum compensation.
Investigation – There’s always more than what’s on the surface. Our Florida personal injury attorneys are here to investigate every aspect of your claims, and the circumstances that led to the accident, and determine all potential at-fault parties involved.
Demand Package – Once we’ve evaluated your claims, conducted an investigation, and determined the maximum medical improvement (MMI) associated with your injuries, we’ll compile and submit a ‘Demand Package’ to the at-fault party’s insurer. At this point, the insurance company can agree to our terms and settle, make a counter offer, or refuse
Negotiate – Depending on the circumstances, available evidence, and insurer, negotiations during the settlement process are expected. Our attorneys are experienced, skilled, and won’t settle until we’re sure you’re getting the maximum compensation you’re owed.
Settlement or Lawsuit – In many cases, our firm will reach a fair settlement with the insurer. However, if they are unwilling to pay for your injuries, lost income, pain, suffering, etc., then we’re ready to file a lawsuit and take your case to court.
If you’re tired of dealing with creditors that threaten lawsuits, wage garnishment, or unfair settlement offers, but don’t think you have enough money to hire a lawyer, think again. Our debt settlement attorneys offer affordable legal fees and payment plans for debt settlement and debt relief programs that fit nearly every budget.
Further, if you’ve been injured in an accident and need a personal injury lawyer, you don’t owe us anything unless we win your case. Contact us today for a free consultation with a trusted Florida lawyer to learn about your options.
